After losing his appeal against the cheating charges brought against him, Phil Ivey has been ordered to repay Borgata $10.1 million. This order was issued by the US District Judge on December 15th after the judge ruled that Ivey was in fact obligated to repay the casino.
Based on his judgment, Judge Noel Hillman ruled that both his partner Yin Sun and Ivey were in breach of their agreement of paying Borgata which means that they must return their winnings. These charges are based on allegations made against the gambler that, while playing baccarat, he cheated his way to a win.
The judge is taking Ivey’s side with regards to the payment the gambler has to make. Using a “status quo ante theory,” Hillman ordered both players to make the repayment before the “formation of a contract” which is the amount Ivey took away soon after the session.
Although Ivey isn’t too thrilled about paying back the money, the judge was lenient when he ordered $10.1 million as opposed to the $16 million, which is what Ivey could have been requested to pay back. Soon after winning its case against Sun and Ivey, Borgata was also given the option of claiming back any damages it believed were incurred during the incident.
Borgata also requested an additional $5.6 million, which they feel Ivey would have lost had the gambler continued to play without the marked cards he was using. Interestingly, Ivey wasn’t responsible for the markings on the cards nor was he liable for using the cards during the games. Due to this, the judge was forced to rule Ivey took full advantage of the flaw and breached his fair play contract with the casino.
However, if the judge had sided with Borgata on the fair play, misconduct, the ruling could have set a rather bad precedent for the US casino industry as a whole. This could have in turn opened a can of nasty claims with similar cases. For both Ivey and Sun, they need to pay back the money.

Brothers Michael and Bryan Voltaggio are opening their first joint venture – Voltaggio Brothers Steak House. According to new stats from the UK Gambling Commission (UKGC), online gambling is currently the most dominant form of gambling in the United Kingdom. The news came as the UKGC published its latest gambling market report, which stems from April 2015 to March 216. This is the first report to cover a year’s worth of information.
In the past, the UK only required UK online operators to hold a UKGC license starting in November 2014. Between April 2015 till March 2016, online gambling operators accumulated a revenue of £4.5 billion. This includes one-third of the gambling market, including the National Lottery sums which were a staggering £3.4 billion, brick and mortar casinos which accumulated £1 billion, with high street bookmakers making £3.3 billion.
As the top online gambling portal, casinos have generated £2.6 billion, which includes £1.75 billion from slots. Other forms of gambling which accumulated massive amounts include: poker generated under £99 million, exchange betting made £152 million, remote sports betting £1.8 billion, pool betting £26 million and bingo made £152.6 million.
Other forms of betting also accumulated the following: horse racing made 22% profit while football made 37% of online betting. Golf, cricket, dog racing and various financial rounded off the various online betting markets according to market performance. Online gambling software providers also managed to make a profit of £364.5 million from UK-licensees with revenues sitting at 55.3%.
Former Amaya Gaming CEO, David Baazov, has expressed his plans of buying the online gambling establishment despite his backers stating that it had no involvement in the C$3.65 billion bid. The company’s shares fell by 6%. Rose by 2.6% after Baazov issued a statement where he shared his plans of acquiring alternative funding.
Baazov’s offer was in jeopardy soon after the Globe and Mail newspaper published an interview with Kalini Lal, CEO of investment firm KBC Aldini Capital.
According to Baazov, Lal, was said to be one of four international investors, which Lal has declined to say that he did not agree to provide funds. In the statement made by Baazov, he was advised by representatives of KBC Aldini Capital that an equity commitment letter supposedly to be delivered to him on behalf of KBC was delivered with KBC’s knowledge. KBC confirmed that it had not committed to providing financial aid.
“Baazov intends to obtain replacement financing and still currently intends to acquire Amaya on the terms previously disclosed by him on November 14, 2016,” the statement said. Baazov now owns 17% of Amaya, spoke last week that he intends on making an offer of C$24 per share on behalf of the soon to be formed entity led by himself and backed by four international investors, including KBC Aldini.
During an interview with the Globe and Mail, Lal, KBC Aldini’s founder and CEO, said: “I don’t know who Amaya is. We have not given any commitment, nor have we had any discussions or any type of verbal communication.” According to Lal, KBC Aldini filed a complaint with the U.S. Securities and Exchange Commission; this is the same commission which regulates Amaya in the U.S.
In a statement issued by Amaya soon after the market closed, the company said that it’s continuing to “carefully assess” Baazov’s proposal, including the information published in the Globe and Mail report and will not make any further comment at this time.
